Terms & Conditions
These Terms and Conditions (“Terms”) govern your use of the Fixa platform, including the Super Admin Web App, Tenant Web App, Tenant Mobile App, and USSD Application (collectively, the “Services”), operated by Fixa Limited (“Fixa”, “we”, “our”, or “us”).
By accessing or using our Services, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Scope of Services
Fixa provides digital tools to help employers and field managers manage workers, attendance, and payroll activities.
The Tenant Web App is for employer HR and finance personnel.
The Tenant Mobile App is for field/site managers.
The USSD Application allows employees to check work details and payslips.
2. Eligibility
You may only use our Services if:
You are at least 18 years old,
You are authorized by your employer or organization to use the platform, and
You comply with these Terms and applicable laws.
3. User Responsibilities
By using the Services, you agree to:
Provide accurate information when onboarding employees.
Maintain confidentiality of login credentials.
Use the Services only for lawful purposes.
Notify Fixa of any unauthorized access or security breaches.
You must not:
Reverse engineer, hack, or misuse the Services.
Upload harmful code or attempt to disrupt operations.
Use the Services to process unlawful data.
4. Data Protection & Privacy
Your use of the Services is also governed by our [Privacy Policy], which explains how we collect, process, and protect personal data.
By using the Services, you acknowledge that Fixa processes personal data as described in the Privacy Policy and in compliance with Law No. 058/2021 of Rwanda and other applicable data protection regulations.
5. Intellectual Property
All content, software, trademarks, and logos in the Services are the property of Fixa Limited or its licensors.
You are granted a limited, non-exclusive, non-transferable license to use the Services solely for authorized business purposes.
6. Payment & Pricing (If Applicable)
Where applicable, employers may be required to pay subscription fees for certain Fixa Services.
Pricing is outlined in separate agreements with clients.
Non-payment may result in suspension or termination of access.
7. Service Availability
We aim to keep our Services available at all times but do not guarantee uninterrupted or error-free operation.
Fixa is not liable for downtime, data loss, or other disruptions caused by factors beyond our control.
8. Limitation of Liability
To the fullest extent permitted by law:
Fixa is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
Fixa’s total liability is limited to the fees paid by your organization in the last 12 months (if applicable).
9. Termination
We may suspend or terminate access to the Services if:
You breach these Terms,
We discontinue the Services, or
Required by law.
10. Governing Law
These Terms are governed by the laws of the Republic of Rwanda.
Any disputes shall be resolved under the jurisdiction of Rwandan courts.
11. Changes to Terms
Fixa may update these Terms from time to time.
We will notify users of material changes through email or in-app notifications.
Continued use of the Services after changes signifies acceptance.
